Qasim Suri’s order to approve resignations declared illegal


We have to change our thinking, respect Parliament, Islamabad High Court

The Islamabad High Court rejected the petition against the phased approval of the resignations of the PTI MLAs.

The Chief Justice of the Supreme Court, Athar Minullah, rejected the PTI’s request while conducting the hearing.

The Islamabad High Court also declared illegal the order of PTI Deputy Speaker Qasim Suri accepting the resignations of 123 members of the Assembly.

The court also rejected PTI’s lawyer’s request to constitute a larger bench.

During the hearing, PTI’s lawyer told the court that 123 PTI members of the assembly submitted their resignations, out of which only 11 resignations were accepted.

Chief Justice Athar Minullah said that the court had decided in 2015 on the procedure for accepting the resignations of the members of the assembly.

The PTI lawyer said that the situation has changed since 2015.

The Chief Justice asked him to read the 2015 decision of the Islamabad High Court on the resignations of the members of the assembly. The court cannot interfere in the affairs of the parliament.

The court declared that the Speaker has satisfied himself regarding the 11 approved resignations of the members of the National Assembly, this court does not have the authority to review the standard of satisfaction of the Speaker of the National Assembly.

Chief Justice Athar Minullah said that we have to change our thinking, we should respect the Parliament, the Islamabad High Court has laid down some principles in the first decision.

The court said that unless the resignations of the members of the assembly are accepted, is it not their duty to represent the people in the parliament? Every member who resigns shall appear before the Speaker individually and confirm his resignation.

Chief Justice Athar Minullah said that the court will not issue orders to the speaker of the National Assembly, what the deputy speaker did was against the laws and court decisions, the court will not interfere in the affairs of the parliament.

Lawyer Faisal Chaudhry said that an attempt is being made to break our party by picking and choosing.

Chief Justice Athar Minullah said that the members of the assembly are not alone, they are the representatives of the people of their constituency, everyone is bound to follow the constitution and the law.

PTI’s lawyer said that Deputy Speaker Qasim Suri had accepted the resignations of PTI members of the assembly.

Chief Justice Athar Minullah said that the notification of Deputy Speaker National Assembly Qasim Suri is unconstitutional.

Irfan Qadir, the lawyer of Speaker National Assembly Raja Pervaiz Ashraf, gave arguments and said that the same person is asking to contest elections on 9 seats.

On which PTI’s lawyer said that it is PTI’s decision as to who will fight from where.
