Acceptance of resignations, petition of PTI assembly members set for hearing

The Islamabad High Court has fixed for hearing the petition of PTI assembly members regarding acceptance of resignations.

Chief Justice Athar Minullah will hear PTI’s request tomorrow.

The request of the PTI assembly members to be heard today was rejected by the Supreme Court.

Earlier, the members of the assembly of Pakistan Tehreek-e-Insaaf have approached the Islamabad High Court regarding the acceptance of resignations.

PTI’s petitioning MLAs include Ali Muhammad Khan, Fazal Muhammad Khan, Shaukat Ali, Dr. Shireen Mazari, Dr. Shandana Gulzar, Fakhar Zaman Khan, Farrukh Habib, Ijaz Shah, Jameel Ahmed, Muhammad Akram.

The petitioners have requested the Supreme Court to direct the Speaker to fulfill his constitutional duty to accept the resignations.

The PTI petitioners have requested that the court direct the Speaker to summon the petitioners and 112 other members.

It has been asked in the petition that the Speaker should investigate whether those who resigned voluntarily resigned under Article 64.

The petitioners say that according to law the Speaker cannot accept the resignations without hearing the petitioners.

The PTI MLAs have taken a stand in the petition that the election has not been announced yet, the resignations of 123 members have not been seen together, so the letter of the petitioners regarding the resignations has not been effective.

The petitioners have taken the position that when the resignation of Member of Assembly Shakur Shad was accepted, they applied, the Speaker accepted Shakur Shad’s resignation without hearing it.

The PTI MLAs have further stated in their petition that the High Court suspended the notification of approval of Shakur Shad’s resignation.

The petitioners in their petition filed in the court have also stated that the petitioners did not appear before the Speaker and therefore their resignations were not accepted.
